
HOUSE CONCURRENT RESOLUTION NO. 76

Stephens, Tucker, Walters, Varner and Yeager)

Requesting the Joint Committee on Government and Finance to
conduct a study of current trends in the practice of
barbers, cosmetologists, manicurists and aestheticians in
West Virginia and the adequacy of current law to protect the
public interest.
Whereas, The Legislature is charged with protecting the
public against unscrupulous professional practices; and
Whereas, The State regulates and monitors the practice of
professions through licensing boards, comprised primarily of
professionals practicing in the profession being regulated, that
verify credentials, require continuing education, resolve
complaints against licensees, and otherwise monitor the practice
of the profession; and
Whereas, The West Virginia Board of Barbers and
Cosmetologists section of the West Virginia State Code should be
clarified to update language reflecting the current practices of
barbers, cosmetologists, manicurists and aestheticians; and,
Whereas, Proposals have been presented to the Legislature
regarding continuing education requirements for barbers,
cosmetologists, manicurists and aestheticians in West Virginia,
to continue education; and
Whereas, Proposals have been presented to the Legislature to
exempt barbers from the requirements of continuing education; and
Whereas, Proposals have been presented to the Legislature
concerning the regulations of shampooing, braiding, and other
related activities; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby
requested to study the regulation of the practice of barbers,
cosmetology, manicurists and aestheticians in West Virginia, with
specific emphasis on the following areas of inquiry:
(a) Whether the state board has developed procedures which
are adequate to reflect the current practices of barbers,
cosmetologist, manicurists and aestheticians; and
(b) Whether the public may be adequately protected by allowing the current language in the West Virginia Code regarding
the practice of barbers, cosmetologists, manicurists and
aestheticians to be maintained; and, be it
Further Resolved, That the Joint Committee on Government
and Finance report to the Legislature during of the regular
session of the Legislature, 2002, on its findings, conclusions
and recommendations, together with drafts of any legislation
necessary to effectuate its recommendations; and, be it
Further Resolved, That the expenses necessary to conduct
this study, to prepare a report and to draft necessary
legislation be paid from legislative appropriations to the Joint
Committee on Government and Finance.
